1) Acceptance of These Terms

By accessing, browsing, purchasing, subscribing to, or using the Service, you agree to these Terms and Conditions (“Terms”). If you do not agree, do not use the Service.

You represent that you have the legal capacity to enter into a contract in your jurisdiction.

2) What We Provide (Information Service Only)

The Service provides sports-related content that may include (without limitation) picks, predictions, opinions, model outputs, analytics, commentary, performance tracking, and educational or informational materials (“Content”).

We are not a sportsbook, casino, betting exchange, escrow, or gambling operator. We do not accept wagers, place bets on your behalf, handle betting funds, or pay prizes/winnings. Any betting you choose to do is done entirely on third-party platforms and at your sole discretion.

3) Entertainment / Informational Purposes Only — No Guarantees

All Content is provided for entertainment and informational purposes only. You acknowledge and agree that:

  • Sports betting involves risk and can result in losses.
  • Past performance is not indicative of future results.
  • We do not guarantee outcomes, profits, or success.
  • Content may be incomplete, delayed, incorrect, or changed at any time.

4) Not Financial, Investment, Legal, or Tax Advice

Nothing on the Service constitutes financial advice, investment advice, legal advice, or tax advice. You are responsible for seeking advice from qualified professionals as needed.

5) Eligibility, Location, and Legal Compliance

You are solely responsible for ensuring your use of the Service and any actions you take based on Content comply with applicable laws and regulations.

By using the Service, you represent and warrant that:

  • You are at least 18 years old, and if your jurisdiction requires a higher age to participate in sports betting (often 21+), you meet that requirement.
  • You will only place bets where doing so is legal, and you will comply with all laws in your jurisdiction.
  • You are not prohibited from receiving the Service under any applicable law.

We may restrict access in certain jurisdictions at our discretion.

6) Responsible Gambling

We encourage responsible gambling. Do not bet more than you can afford to lose. If you think you may have a gambling problem, seek help. In the U.S., you can contact 1-800-GAMBLER (where available) or local resources in your area.

7) Accounts and Security

To access certain features, you may need to create an account. You agree to:

  • Provide accurate information and keep it updated.
  • Maintain the confidentiality of login credentials.
  • Notify us immediately of any unauthorized use.

You are responsible for all activity occurring under your account.

8) Subscriptions, Billing, and Auto-Renewal

If you purchase a subscription, you authorize recurring charges using your selected payment method.

Auto-renewal: Unless canceled, your subscription will automatically renew at the end of each billing period at the then-current price and terms disclosed at purchase.

We may change subscription pricing and features prospectively. If required, we will provide notice (e.g., on the Service or via email).

9) Cancellation Policy

You may cancel at any time. Upon cancellation:

  • You will retain access through the end of your current paid billing period.
  • Your subscription will not renew after that period ends.

10) Refund Policy — All Sales Final

All sales are final. No refunds.

This includes (without limitation) partial periods, unused time, service interruptions, absence of picks on a given day, changes in sports season availability, or performance outcomes.

If a charge is reversed due to a dispute/chargeback, we may immediately suspend or terminate access.

11) Service Availability; Changes; No Obligation to Provide Picks

We may modify, suspend, or discontinue any part of the Service (including specific sports coverage) at any time. We do not guarantee:

  • That picks will be issued every day or during any specific period.
  • That any sport, league, or feature will be continuously available.
  • That the Service will be error-free or uninterrupted.

12) Prohibited Conduct

You agree not to:

  • Copy, scrape, crawl, harvest, redistribute, republish, or resell Content (including picks) without our written consent.
  • Share paid Content publicly or with non-subscribers (including group chats, Discords, “pick resale,” etc.).
  • Reverse engineer or attempt to infer proprietary models/logic.
  • Use the Service for unlawful purposes.
  • Interfere with security or operation of the Service.
  • Impersonate others or misrepresent affiliation.

We may suspend/terminate accounts for suspected violations.

13) Intellectual Property

All Content and materials on the Service (including logos, branding, text, graphics, and the selection/arrangement of Content) are owned by us or licensed to us and are protected by intellectual property laws.

Limited license: We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access the Content for your personal use while your subscription is active, subject to these Terms.

14) User Content (If Applicable)

If you submit content (e.g., comments, messages, feedback), you grant us a non-exclusive, worldwide, royalty-free license to use it for operating/improving the Service. You represent you have rights to submit it and it does not violate laws/rights.

15) Third-Party Services and Links

The Service may reference third-party sites (e.g., sportsbooks, data providers, social platforms). We do not control third parties and are not responsible for their content, policies, or actions. Your use of third-party services is at your own risk and subject to their terms.

16) Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING (WITHOUT LIMITATION) WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

17) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.
  • OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR $100, WHICHEVER IS GREATER).

YOU ACKNOWLEDGE THAT THIS LIMITATION IS A FUNDAMENTAL BASIS OF THE BARGAIN.

18) Indemnification

You agree to defend, indemnify, and hold harmless the Company from claims, damages, liabilities, losses, and expenses (including attorneys’ fees) arising from or related to your use of the Service, your breach of these Terms, or your violation of law or third-party rights.

19) Dispute Resolution; Arbitration; Class Action Waiver

Informal Resolution First: Before filing a claim, you agree to contact us at admin@theunderdogsniper.com and attempt to resolve informally for at least 30 days.

Binding Arbitration: If not resolved, any dispute arising from these Terms or the Service will be resolved by binding arbitration, not in court, except you may bring claims in small claims court if eligible.

Class Action Waiver: Disputes will be brought only on an individual basis. You waive any right to participate in class or representative actions.

20) Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Where arbitration does not apply, exclusive venue will be state/federal courts located in San Francisco County, California.

21) Changes to These Terms

We may update these Terms at any time. Updated Terms will be posted with a new “Last Updated” date. Continued use after changes means you accept the updated Terms.

22) Severability; Assignment; Entire Agreement

If any provision is unenforceable, it will be modified to the minimum extent necessary and the remainder will remain in effect. You may not assign these Terms without our consent. These Terms constitute the entire agreement regarding the Service.
